SECTION 28 IPC : “Counterfeit” refers to the act of making something appear to be something else with the intent to practice deceit or with knowledge that it is possible that deception would be used as a result. [Explanation 1: It is not necessary for a counterfeit replica to be precise. It is presumed, until the contrary is proven, that the person who made the two objects resemble one another intended to practice deception through the use of the resemblance or knew it was likely that deception would be practiced thereby. [Explanation 2: When a person makes one object resemble another, and the similarity is such that a person might be deceived thereby.]
