SECTION 39 IPC : “Voluntarily”.—When a person employs a method to bring about an outcome that he meant to bring about or one that, at the time the method was used, he knew or had reason to believe was likely to bring about, it is said that the method was used “voluntarily.” Illustration In order to facilitate a heist, a sets fire to an occupied residence in a big city late at night, killing someone in the process. Even though A may not have wanted to cause death in this situation and may even regret doing so, he has caused death voluntarily if he was aware that it was likely to happen.
