SECTION 80 IPC : Accidentally performing a legal act.—Nothing that is done by chance or misfortune, without any criminal intent or knowledge, and by using proper care and caution while performing a legal act, in a legal manner, by means of a legal law, is considered to be an offense. Illustration A is using a hatchet; as it strikes something, the head flies off and kills a bystander. Here, A’s action is excuseable and not illegal if there was no lack of appropriate caution on his behalf.
