SECTION 91 IPC : Exclusion of behaviors that violate the law regardless of the harm they inflict.The exceptions in sections 87, 88, and 89 do not apply to actions that constitute crimes on their own, regardless of the harm they may cause, are intended to cause, or are known to be likely to cause to the person giving the consent or the party on whose behalf the consent is provided. Illustration Independent of any harm that it may inflict or be intended to cause to the lady, inducing a miscarriage is illegal (unless done so in good faith to save the woman’s life). As a result, it is not an offense “by reason of such harm”; furthermore, the consent of the woman or of her guardian to the cause of the miscarriage does not excuse the crime.
