A High Court Judge is a well-known and esteemed lawyer who occupies a significant position in a nation or particular region’s court system. Chief Justice in Acting
When one of the following conditions occurs:
- The office of chief justice of the high court is vacant;
- The chief justice of the high court is temporarily absent; or
- The chief justice of the high court is unable to carry out the functions of his office, the President may appoint a judge of a high court as acting chief justice of the high court.
Judges, both additional and acting
When any of the following two conditions exists:
- the high court’s workload temporarily increases; or
- there are backlogs of work.
The President may appoint suitably competent individuals as extra judges of a high court for a temporary period not to exceed two years. When a judge of a high court (other than the chief justice) is either:
- Appointed to act temporarily as chief justice of that high court; or
- Unable to perform the duties of his office due to absence or any other reason, the President may also appoint a duly qualified person as an acting judge of that high court.
Until the permanent judge returns his position, the acting judge is in charge. However, if a judge reaches the age of 62, neither the additional judge nor the acting judge can continue in their position.
Former judges
The chief justice of a state’s high court may at any time ask a retired judge from that court or any other high court to fill in as a judge on the state’s high court for a temporary term. Only with the prior approval of both the President and the person who would be thus nominated is he able to do so. A judge of this type is entitled to whatever benefits the President decides. He will also have access to all of the court’s jurisdiction, authority, and privileges. He won’t, however, be regarded in any other way as a member of that high court.
