Indian Penal Code Section 106: Right to self-defense against a fatal assault when an innocent person is at risk.—If the defender is in a position where he cannot effectively exercise his right to private defense against an assault that reasonably raises the possibility of death without running the risk of hurting an innocent person, his right to private defense includes taking that risk. A mob attacks Illustration A and tries to kill him. He cannot effectively use his right to private defense without opening fire on the mob, and he cannot open fire without running the risk of injuring the mob’s mixed-up small children. A does not violate the law if he injures any of the kids in this way.
