Indian Penal Code Section(IPC) 105: beginning and continuing of the right of private property defense. When a legitimate fear of danger to the property first materializes, the right to private property defense kicks in. Until the criminal has fled with the stolen goods, aid from the government is secured, the stolen goods have been recovered, or the right of private property defense against theft has expired. As long as the perpetrator causes or attempts to cause any person’s death, injury, or unjustified restraint, or as long as there is a continuing fear of instantaneous death, instantaneous injury, or instantaneous personal constraint. As long as the perpetrator continues to commit criminal trespass or mischief, the right to private property defense against those crimes is still in effect. As long as the house trespass that was started by the nighttime housebreaking continues,ipc section 105 provide private property owners have the right to defend their homes.
